Data protection

Public index of procedures 
in accordance with Section 4 e of the German Federal Data Protection Act (Bundesdatenschutzgesetz - BDSG)
 
Section 4 g of the BDSG prescribes that the data protection commissioner must disclose the following information to everyone in an appropriate manner in accordance with Section 4 e:

1. Name of responsible body:		SüdLeasing GmbH

3. Address of responsible body:		Pariser Platz 7, 70173 Stuttgart, Germany

4. Intended purpose of data collection, processing or use:

Object of the company is the:

• a) acquisition, sale, rental and lease of movables;
• b) acquisition, sale, construction, rental, lease and management of properties and rights similar to property rights as well as equity interests in companies concerning the company's object;
• c) takeover and disposal of equity interests in companies;
• d) carrying out real and recourse factoring agreements if they are not banking transactions
  
  

in both the leasing business and comparable financial transactions as defined by the German Banking Act.

The Company can perform transactions of any kind that indirectly or directly serve its objective. It may also acquire, rent or lease companies of the same or similar type and take equity interests in them. It may establish subsidiaries.

Data is collected, processed and used to fulfil the above-mentioned objective. Personal data is

• Particulars (e.g. name, address, telephone number, mailing address, date of birth, marital status and profession/industry)
• Asset data (properties, securities)
• Contractual data (loan, leasing and insurance agreements)
• Origin of assets
• Information on the industry and business partners

Video surveillance is used to protect the premises.

5. Definition of affected groups of persons and the relevant data or data categories:

Personal data is collected, processed and used primarily regarding the following groups of people:

• Customer data (address information, contractual data, data on financial services)
• Data on interested parties (address information)
• Employee data, applicant data, broker/estate agent data, agency data (personal information for HR management)
• Business partners, brokers and estate agents (data on addresses, invoices and services )
• Suppliers (address and functional data)

6. Recipients or categories of recipients with whom data can be shared:

• Official bodies that obtain the data due to legal requirements (e.g. social insurance carriers)
• Internal bodies that participate in implementing and performing their respective business processes (e.g. HR management, credit worthiness checks, accounting, sales, marketing, audit and IT/Organisation)
• External contractors (service companies) in accordance with Section 11 of the BDSG (Federal Data Protection Act)
• Other external offices such as subsidiaries or associated companies as part of their broker activities

7. Adjustment periods for the deletion of data:

The legislator established a number of requirements for maintaining and retaining records. Following the expiration of these requirements, the corresponding information is deleted if it is no longer necessary for the performance of the contract (e.g. lease agreement).

Data no longer affected by this is deleted if the intended purposes under 4 no longer apply.

8. Intended transfer to third-party states

Data is transmitted to third-party states to perform the contract, for mutual trust similar to that in a contract and to advise the individual concerned.

9. Security in data processing

The security of data processing in accordance with the Annex to Section 9 of the BDSG is safeguarded by internal operational measures the Company has taken.
